This matter was taken up for hearing under the caption "For Being Mentioned" today at the instance of the learned counsel for the revision petitioners.

2. The learned counsel for revision petitioners would submit that this Court by an order dated 27.10.2021 disposed of the above C.R.P. However, he would submit that this court while condoning the delay imposed a cost of Rs.10,000/- payable to the respondents/plaintiffs. He would submit that as per the order of this court, they are ready to pay the cost, but the respondents/plaintiffs are not inclined to receive the same. Hence, he seeks further direction as they are ready to comply the order. Accordingly, the matter is listed today.

3. Heard the contentions of learned counsel for revision petitioners and perused the order.

4. Considering his submissions, the para 6 at page 3 of the order shall be substituted as follows:

In Para 6 at Page 3 "6. It is true that this application was filed after filing of final decree application by the plaintiffs, though the reason is not justified one. But considering the facts of the suit, more particularly with regard to the relief of partition, this Court is inclined to condone the delay on payment of cost of Rs.10,000/- and the petitioners are directed to deposit the cost into the credit of A.S.CRF.No.10150 of 2017 on the file of Subordinate Judge, Kangeyam within a period of two weeks from the date of receipt of copy of this order."

5. Registry is directed to incorporate above correction in the Order of this Court in C.R.P.No.1880 of 2019 dated 27.10.2021 and issue fresh order copy to the petitioner.
