4 K.PERUMAL [ RESPONDENTS ] Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus directing the respondents 1 to 3 to cancel the Sale Deeds dated 26.11.2012 registered as Doc. Nos. 4389 and 4390 of 2012 on the file of the Sub-Registrar Kunnathur as per the Circular No.67 dated 03.11.2011 issued by the 1st respondent and take necessary penal action against the 4th respondent by considering the representation dated 14.02.2013.

[Order of the Court was made by A.SELVAM, J.] This Writ Petition has been filed under Article 226 of the Constitution of India praying to direct the respondents 1 to 3

to cancel the Sale Deeds dated 26.11.2012 as per Circular No.67 dated 03.11.2011 by way of issuing a writ of mandamus.

2. Learned counsel appearing for the petitioner has advanced his arguments on the basis of the averments made in the petition.

3. Learned Additional Government Pleader appearing for respondents 1 to 3 has submitted a copy of Circular dated 20.10.2017 issued by the Government of Tamil Nadu, wherein, it has been specifically stated that Circular No.67 dated 03.11.2011 has been withdrawn on 20.10.2017.

4. Since the Circular in question has already been withdrawn on 20.10.2017, the reliefs sought in the petition have become infructuous and therefore, the present writ petition deserves to be dismissed.

5. In fine, the writ petition stands dismissed as infructuous without costs.

Consequently, connected miscellaneous petition is closed.
