Prayer: This Petition filed under Article 226 of the Constitution of India, seeking a Writ of Certiorari to call for the records and to quash the conditional order passed by the first respondent in his proceedings Ref.No.047345/E3/4/2021, dated 02.07.2021.

(The case has been heard through video conference) By consent of the learned counsel on either side, this writ petitions is taken up for final disposal and is disposed of by means of this order.

2. Mr.S.Arumugam, learned Government Advocate accepts notice on behalf of the respondents.

3. The petitioner has filed the present writ petition seeking to quash the conditional order passed by the first respondent in his proceedings Ref.No.047345/E3/4/2021, dated 02.07.2021.

4. This Court heard the submissions of the learned counsel on either side and perused the materials placed before it. https://hcservices.ecourts.gov.in/hcservices/

Though the prayer in this writ petition is for a larger relief, the learned counsel for the petitioner has confined his argument to the limited extent of directing the first respondent to consider and dispose of the fresh representation to be submitted by the petitioner within a week by following the similar order passed by the first respondent in Dr.T.Balamurugan case in Ref.No.53611/E4/2/2019, dated 29.08.2019.

This Court considering the limited prayer now sought for by the learned counsel for the petitioner, without going into the merits of the case, direct the petitioner to submit a fresh representation to the first respondent within a period of one week from the date of receipt of a copy of this order and upon receipt of the said representation of the petitioner, the first respondent is directed to consider and dispose of the said representation of the petitioner on merits and in accordance with law and pass appropriate orders by following the similar order passed by the first respondent in Dr.T.Balamurugan case in Ref.No.53611/E4/2/2019, dated 29.08.2019, within a period of four weeks thereafter and communicate the decision taken, to the petitioner herein.

7. With the above directions, this writ petition stands disposed of.

Consequently, the connected miscellaneous petitions are closed. No costs.
