(CRIME NO.64/2005) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To exempt the petitioner from surrendering in C.A.No.17 of 2016 on the file of III Additional District and Sessions Judge, Tiruppur at Dharapuram dated 26.08.2020, partly confirming the Judgment dated 22.01.2016 made in C.C.No.290 of 2009 on the file of Judicial Magistrate Court No.II, Udumalpet, pending disposal of the above Crl.R.C.No.828/2020.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. S.ARJUN, Advocate for the petitioner, and of M/S.P.KRITIKA KAMAL Govt. Advocate ( Crl. Side) on behalf of the Respondent, the court made the following order:- This miscellaneous petition is filed to exempt the petitioner from surrendering before the trial Court, as ordered by the learned III Additional District and Sessions Judge, Tiruppur at Dharapuram, vide order dated 26.08.2020 in C.A.No.17 of 2016.

2. Heard Mr.S.Arjun, learned counsel appearing for the petitioner and Mrs.P.Kritika Kamal, learned Government Advocate (Crl. Side) for the respondent.

3. In view of the order of this Court in Crl.MP.No.5833 of 2020 in Crl.R.C.No.828 of 2020, directing the petitioner to surrender before the trial Court, this petition seeking exemption from surrender cannot be considered, and hence, this petition stands dismissed.
