Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying for the issuance of a direction in the nature of Writ of Declaration declaring that the petitioner is entitled to get pension based on the last drawn basic scale of the salary drawing as on 31.05.2003 at Rs.5,300/- and the pension sanction based on the basic scale of Rs.5,200/- is not correct consequently directing the respondents to sanction pension on the basic scale of Rs.5,300/- and thereby directing the respondents to pay difference of pensionary benefits reduced by the respondents based on wrong fixation and 1/4
set aside the recovery of Rs.29,136/- and direct the respondents to pay the recovered amount from DCRG along with interest and to pay all the attended benefits to the petitioner and pass such further orders. For Petitioner :
