Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 4th respondent to consider the representation dated 24.03.2016 to cancel the order of assignment of land and patta comprised of S.No.762/3 measuring about 40 cents of agricultural land situated at Ayilam Village, Valaja Taluk, Vellore District, in favour of the 5th Respondent.

The petitioner claims to be in possession of the land admeasuring an extent of 40 cents in S.No.762/3 at Ayilam Village, Valaja Taluk, Vellore District and he was also issued with B Memo in respect of the said property and it is also subject to statutory levies. The petitioner submitted representations dated 09.05.1998, 13.02.2004, 02.05.2005 seeking for patta in respect of the property, but it was https://hcservices.ecourts.gov.in/hcservices/

not considered by the fourth respondent. However, he issued an order dated 16.12.2006, in favour of the fifth respondent under Special Scheme for distribution of Government waste land to landless poor agricultural families. The petitioner objecting to the same, has submitted a representation dated 22.12.2006 and he was also repeatedly approaching them for cancellation of the said order and the last of such representation was submitted on 24.03.2016 and since no orders have been passed, came forward to file this writ petition. 2.The learned counsel appearing for the petitioner is absent. Heard the submissions of Mr.P.Sanjai Gandhi, learned Additional Government Pleader, who accepts notice on behalf of the respondents 1 to 4.

3.Though the petitioner prayed for a larger relief, this Court in the light of the above facts and circumstances and without going into the merits of the same, directs the fourth respondent to consider and dispose of the petitioner's representation dated 24.03.2016, in accordance with law, after putting on notice, the fifth respondent and pass orders within a period of twelve weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the fifth respondent. 4.The writ petition is disposed of accordingly.
