Sub Application No.1050 of 2025 in Cont.P.No.2090 of 2025 is filed seeking to dispense with the personal appearance of the applicant/1st respondent in Cont.P.No.2090 of 2025.

O R D E R

Pursuant to statutory notice issued by this Court vide order dated 25.08.2025, Mr.S.Gopala Sundara Raj, IAS, The Secretary, Tamil Nadu Public Service Commission, the first respondent herein is present before this Court. He has also filed an affidavit dated 17.09.2025 before this Court. 2.Mr.B.Vijay, learned Standing Counsel appearing for the first respondent would submit that this Court, while passing interim order on 04.12.2024 in W.P.No.36849 of 2024, finding that prima facie case has been made out, had directed the respondents not to finalise the selection until further orders are passed by this Court. He would further submit that the first respondent vide publication dated 11.04.2025, though specifically mentioned the register numbers, who have been provisionally admitted to the Onscreen Certificate verification, it is purely provisional, subject to the 2/5

outcome of W.P.Nos.34493 and 36849 of 2024, W.A.No.3782 of 2024, W.A.(MD) No.181 of 2023 and CMP (MD)No.2247 of 2023 and other cases, if any, pending before this Court and thereby, the selection has not been finalised.

3.The relevant paragraph of the affidavit filed by the first respondent dated 17.09.2025 reads thus:

"The applicant submits that this Hon'ble Court was pleased to issue statutory notice on 25.08.2025 for non compliance of direction issued by this Court. It is reiterated that the Commission has only completed the process of Onscreen Certificate Verification and final selection process has been deferred in compliance with the interim direction of this Court. Ergo, there is no wilful or wanton disobedience of direction of this Court as contended by the petitioner." 4.Mr.S.Gopala Sundara Raj, IAS, The Secretary, Tamil Nadu Public Service Commission, who had appeared before this Court, would submit that in due compliance of the order of this Court he undertakes that there shall not be any further selection process in this regard. This submission is recorded.

5.The personal appearance of the first respondent is dispensed 3/5

with and Sub Application No.1050 of 2025 is ordered accordingly. 6.In view of the above, this Court finds that no contempt has been committed and respondents 2 and 3 are not necessary parties in the contempt petition. Accordingly, this contempt petition stands closed. However, it is made clear that the order of this Court dated 04.12.2024 shall be duly followed in letter and spirit.
