O R D E R

(The case has been heard through video conference) The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 328 IPC r/w.24(1) of Tobacco Act in Crime No.466 of 2020 on the file of the respondent police, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner was found in possession of 13 tons of Gutka products. Hence, the complaint.

3. The learned counsel for the petitioner would submit that this is second anticipatory bail petition and the earlier petition was dismissed by this Court on 04.09.2020 in Crl.O.P.No.13713 of 2020. Hence, he prays for grant of anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor would vehemently oppose the petition stating that the petitioner was found in possession of 13 tons of Gutka products and there are six previous case pending against him.

5. Taking into consideration the facts and circumstances of the case and this Court had very recently dismissed the earlier anticipatory bail petition on 04.09.2020, this Court is not inclined to grant anticipatory bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. The petitioner shall pay a sum of Rs.1,000/- (Rupees Thousand only) as costs to the credit of the "Chief Justice Relief Fund" (payable in Accounts Section of the High Court Registry), within a period of two weeks from the date of receipt of a copy of this order.
