Prayer: This Criminal Original Petition filed under Section 482 Cr.P.C. praying to extend the time to deposit the 20% of the cheque amount a sum of Rs.10,00,000/- in Crl.M.P.No.7234 of 2022 in Crl.M.P.No.2951 of 2022 in C.A.No.45 of 2022 on the file of learned II Additional Sessions Judge, Chennai and thus permit the petitioner to deposit the 20% of the cheque amount to the credit of C.C.No.2074 of 2017 on the file of the learned XIX Metropolitan Magistrate, Alikulam, Chennai.

ORDER

This Criminal Original Petition has been filed seeking to extend the time to deposit the 20% of the cheque amount of Rs.10,00,000/- in C.C.No.2074 of 2017 on the file of the learned XIX Metropolitan Magistrate, Alikulam, Chennai, passed by the learned Principal Sessions Judge, Chennai, in Crl.M.P.No.7234 of 2022 in Crl.M.P.No.2951 of 2022 in C.A.No.45 of 2022.

2. The learned counsel for the petitioners would submit that the learned Principal Sessions Judge while suspending the sentence imposed on the 2nd petitioner, directed the petitioners to deposit 20% of the compensation amount to the credit of C.C.No.2074 of 2017 on the file of the trial Court within a period of 60 days. Thereafter, a further period of 30 days time was granted from 09.05.2022 to deposit the said amount. Now the learned counsel seeks another 3 months time to deposit the amount on medical ground and he has also filed the discharge summary of the petitioner which shows that the 2nd petitioner's left foot 2nd, 3rd, 4th and 5th toes were amputated due to severe diabetic on 27.05.2022.

Considering the medical report and discharge summary issued by Hariraran Diabetes & Heart Care Hospitals (P) Ltd., three months time is extended from the date of receipt of copy of this order, to deposit the said amount in C.C.No.2074 of 2017 on the file of the learned XIX Metropolitan Magistrate, Alikulam, Chennai,
