PRAYER: Civil Revision Petition filed under Section 227 of the Constitution of India, to set aside the order passed in I.A.No.409 of 2018 in O.S.No.135 of 2016 on 14.02.2020 on the file of the II Additional District & Sessions Judge, Salem.

It is now brought to the notice of the learned counsel for the petitioner herein that the impugned order passed in I.A.No.409 of 2018, filed under Order 9 Rule 13 C.P.C., by the Second Additional District & Sessions Judge, Salem, was allowed on payment of costs and on payment of costs, the matter was taken up for hearing.

3. It is brought to the knowledge of the learned counsel for the petitioner that only now, through the lower Court counsel, he came to know that the cost memo has been filed by the respondent before the Court below, and he has brought the said fact before this Court. 2/4

4. Taking into consideration the cost memo filed by the respondent before the trial Court and the revision petition before this Court, without expressing any opinion as to the impugned order, this Civil Revision petition shall stand closed with a direction to the trial Court to complete the trial which is said to be at examination of the defendant's side, within a period of ten weeks from the date of receipt of a copy of this order.
