Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondents to appoint the petitioner in the suitable post on compassionate ground based upon the application of the petitioner dated 21.02.2014 and until then, not to fill the existing vacancy. ORDER

By consent, the writ petition is taken up for final disposal.

The petitioner claims that he belongs to Adi Dravidar Scheduled Caste Community and his father was working as Electrician in the services of the 3rd respondent and he died in harness on 15.12.2013 due to cancer. The father of the petitioner left behind his wife and 2 sons, viz, the petitioner as well as Thiru Manikandan and the petitioner's grandmother, viz., Kanthayee. The mother of the petitioner submitted an application on 07.01.2014 to the 3rd respondent praying for compassionate ground appointment to the petitioner and also while preferring the application with all necessary testimonials/certificates have also been enclosed. The office of the 3rd respondent has also verified the testimonials/certificates submitted by the petitioner and since no https://hcservices.ecourts.gov.in/hcservices/

orders have been passed, the petitioner submitted a representation dated 24.08.2015 and the office of the 2nd respondent has also directed the 3rd respondent to take appropriate action and send a report as to the request made by the petitioner for compassionate ground appointment and since he has not been favoured with any response, the petitioner came forward to file this writ petition. Heard the submissions of the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader who accepts notice on behalf of the respondents 1 and 2 and Mr.S.Navaneethan, learned Additional Government Pleader who accepts notice on behalf of the 3rd respondent.

Though the petitioner has prayed for a larger relief, this Court, in the light of the above facts and circumstances, directs the 3rd respondent to consider and dispose of the petitioner's representation dated 24.08.2015 on merits and in accordance with law after taking note of the communication of the 2nd respondent dated 26.08.2015 made in Na.Ka.No.2879/2015/Pe.3 and pass orders within a period of four weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner.

The writ petition is disposed of accordingly. No costs. Consequently, the connected miscellaneous petition is closed.
