ORDER
This writ petition has been filed for the issuance of a Writ of Mandamus directing the respondents to deal with the application submitted by the petitioner seeking for renewal of his passport.
2. Heard Mr.S.Suresh, learned counsel for the petitioner and Mr.R.Sugumar, learned Central Government Standing Counsel for the respondents.
3. It is brought to the notice of this Court that a criminal case is pending against the petitioner in S.C.No.9 of 2020 on the file of the Additional Sessions Judge, Tiruvallur and therefore the second respondent is insisting for obtaining an order from the Court in order to deal with the application and renew the passport.
4. Insofar as processing the passport application, where a criminal case is pending, the concerned person must obtain an order from the Court where the case is pending and based on that order, further action will be taken by the Regional Passport Officer. Hence, the petitioner cannot file a writ petition and seek for such a relief. Liberty is granted to the petitioner to move the 2/4
concerned court, get an order and place the same before the second respondent, who shall thereafter deal with the application seeking for renewal of the passport.
5. This writ petition is disposed of in the above terms.
