..Respondent(s) PRAYER: Writ Petition has been filed under Article 226 of the Constitution of India praying to issue a writ of Certiorarified Mandamus calling for the records of the impugned proceedings issued by the 1st respondent vide Na.Ka. 2053/93 (A. Kanimam) dated 09.02.2002 and the consequential attachment notice issued by the 2nd respondent vide Na.Ka. 1202/ 2024/ A3 dated 25.01.2025 and quash the same as illegal, arbitrary, and in violation of the principles of natural justice and consequently grant liberty to the petitioner to challenge the impugned order dated 09.02.2002 issued by the 1st respondent under Section 36-C of Tamil

Nadu Minor Mineral Concession Rules, 1959.

ORDER

The petition has been filed to call for the records of the impugned proceedings issued by the 1st respondent vide Na.Ka. 2053/93 (A. Kanimam) dated 09.02.2002 and the consequential attachment notice issued by the 2nd respondent vide Na.Ka. 1202/ 2024/ A3 dated 25.01.2025 and quash the same as illegal, arbitrary, and in violation of the principles of natural justice and consequently grant liberty to the petitioner to challenge the impugned order dated 09.02.2002 issued by the 1st respondent under Section 36-C of Tamil Nadu Minor Mineral Concession Rules, 1959.

2. When the matter was taken up for hearing, it is fairly conceded by the learned counsel for the petitioner that they have an alternate remedy under Section 30-C(2) of the Tamil Nadu Minor Mineral Concession Rules, 1959. However, since considerable period was lapsed from the date of the filing of the impugned order, he has come with this writ petition and he is ready to go before the authority concerned.

3. Therefore, recording the same, the petitioner is directed to go before the concerned appellate authority and the appellate authority shall not dismiss the appeal on the ground of delay as this Court is of the opinion that sufficient reasons are given for the delay. The petitioner shall file an appeal within a period of two weeks from the date of receipt of a copy of this order. It is needless to state that the appellate authority shall provide a personal hearing. With the above directions, this writ petition is disposed of. No costs.
