consequently grant liberty to the petitioner to challenge the impugned order dated 09.02.2002 issued by the 1st respondent under Section 36-C of Tamil Nadu Minor Mineral Concession Rules, 1959 For Petitioner:

ORDER

The above writ petition has been filed to quash the impugned proceedings issued by the 1st respondent vide Na.Ka.No.2053/93 (A.Kanimam) dated 09.02.2002, as also the consequential attachment notice issued by the 2nd respondent vide Na.Ka. 1202/ 2024/ A3 dated 25.01.2025 and consequently to grant liberty to the petitioner to challenge the impugned order dated 09.02.2002 issued by the 1st respondent under Section 36-C of Tamil Nadu Minor Mineral Concession Rules, 1959.

When the matter is taken up for hearing, it is fairly conceded by the learned counsel for the petitioner that the petitioner has an alternate remedy under Section 30-C(2) of the Tamil Nadu Minor Mineral Concession Rules, 1959. However, since considerable period was lapsed from the date of the filing of the impugned order, the petitioner has come before this Court and he is ready to go before the authority concerned.

3. Therefore, recording the same, the petitioner is directed to go before the concerned appellate authority and the appellate authority shall not dismiss the appeal on the ground of delay, as this Court is of the opinion that sufficient reasons are given for the delay. The petitioner shall file an appeal within a period of two weeks from the date of receipt of a copy of this order. It is needless to state that the appellate authority shall provide a personal hearing to the petitioner.
