Read this order in conjunction with order dated 19.07.2022 which reads as under:- " The only question that survives is as to, whether the petitioner has filed the appeal before the Sales Tax Appellate Tribunal within a period of 30 days from the date of receipt of this Court's order?

2.At the request on behalf of the petitioner to confirm this position, list on 22.07.2022."

2.The report of the Registry is placed on file today, and reveals that copy application of the petitioner has been filed on 21.10.2016 and order has been received on 22.11.2016. The appeal has been filed on 21.12.2016 which is within the time frame as directed by this Court.

3. The petitioner will refile the appeal within a period of three (3) weeks from today accompanied with copies of required annexures. 4.Upon receipt, the appeal shall stand restored to the file of the Sales Tax Appellate Tribunal, the petitioner called upon to appear by issuance of notice, heard and the appeal disposed as expeditiously as possible, in any event, within a period of three (3) months from date of institution.
