The petitioner, who apprehend arrest at the hands of the respondent police for the offences punishable under Sections 303(2), 326(a) of BNS Act(379, 430 of IPC) in Crime No.495 of 2024, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that on 09.11.2024, when the respondent police was in regular patrol duty, the petitioner along with other accused were illegally transporting 4 unit of river sand. Hence, the case.

3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He also submitted that the petitioner is in no way connected with the alleged offence. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4. Learned Government Advocate (Crl.side) appearing for the respondent police, submitted that the petitioner along with other accused had illegally transported 4 unit of river sand. He submits that there are totally two accused in this case. He also submits that there are five previous cases pending against the petitioner which are similar in nature. Hence, he opposed for grant of anticipatory bail to the petitioner.

Considering the above facts and circumstances of the case, nature of allegations, taking note of the submission made by the learned Government Advocate (Criminal Side) and also considering the fact that five previous cases were pending against the petitioner which are similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner.
