(Crime No.8 of 2020) PRAYER: Criminal Miscellaneous Petition is filed under Section 482 of Criminal Procedure Code praying to modify the condition imposed by this Court in Crl.O.P.No.9767 of 2020 dated 02.07.2020 in para:5 which reads as follows that the petitioners are directed to deposit the original title deeds stands in their names not less than the value of Rs.15,00,000/- (Rupees fifteen lakhs only) along with proper valuation certificate obtained from the concerned authority within a period of two weeks from the date on which the order copy made ready and on such deposit the petitioners are ordered to be released on bail in the event of arrest or on their appearance before the learned District Munsif cum Judicial Magistrate Court, Kattumannarkoil, Cuddalore District.

ORDER

(The case has been heard through video conference) This petition has been filed to modify the condition imposed by this Court in Crl.O.P.No.9767 of 2020 dated 02.07.2020 in para:5 which reads as follows that the petitioners are directed to deposit the original title deeds stands in their names not less than the value of Rs.15,00,000/- (Rupees fifteen lakhs only) along with proper valuation certificate obtained from the concerned authority within a period of two weeks from the date on which the order copy made ready and on such deposit the petitioners are ordered to be released on bail in the event of arrest or on their appearance

before the learned District Munsif cum Judicial Magistrate Court, Kattumannarkoil, Cuddalore District.

2.The learned counsel for the petitioners would submit that the petitioners along with one Poongodi was granted Anticipatory Bail by this Court in Crl.O.P.No.9767 of 2020 dated 02.07.2020 subject to the petitioners depositing the original title deeds standing in their names not less than the value of Rs.15,00,000/- (Rupees fifteen lakhs only) along with proper valuation certificate obtained from the concerned authority. He would submit that the petitioners have deposited the title deeds worth about Rs.25,00,000/- (Rupees Twenty Five Lakhs Only). He would submit that the petitioner is the son-in law and Mrs.Poongodi, his mother-in-law has deposited the title deeds and that the petitioner does not own any property and thereby seeks for modification.

3. Heard both sides.

4. Considering the facts and circumstances of the case, the subject condition is modified to that effect that the petitioner shall furnish two Government sureties and and also execute a bond for Rs.25,000/- (Rupees Twenty Five Thousand Only). Failing which, the petition for anticipatory bail shall stand automatically dismissed.
