O R D E R
This writ petition is filed by the petitioner for a direction to the repondents to include his name in the computer patta.
2. Heard Mr.P.Muthamizh Selvakumar, learned counsel appearing for the writ petitioner and Mr.G.Ameedius, learned Government Advocate appearing for the respondents and perused the materials available on record.
3. According to the writ petitioner, in the manual prepared by the revenue officials, his name was very much available in patta No.548 in respect of S.No.140/3, K.S.R.Nagar, Thittakudi, Cuddalore District. However, in computer patta, his name has not been included. Hence, he filed this writ petition with above prayer.
4. Learned Government Advocate appearing for the respondents would submit that since one of the other legal heirs has objected and a suit is also filed by the other legal heir for issuance of legal heir certificate, the petitioner's name has not been included in the computer patta. 2/4
5. The petitioner seeks to include his name in the computer patta and the dispute is not over legal heirship. Therefore, this Court is of the view that mere pendency of a suit for legal heirship certificate will not be relevant for excluding the name of the petitioner in the computer patta, on the basis of the patta prepared by the Revenue authorities, in respect of S.No.140/3 in patta No.548.
6. In such view of the matter, let the authorities consider to include the name of the petitioner, pursuant to the manual patta already prepared by the Revenue authorities, wherein, the name of the petitioner has been very much found. The said exercise shall be completed within a period of two months from the date of receipt of a copy of this order. With the above direction, this writ petition is disposed of. No costs.
