..Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondents to consider the petitioner's representation dated 21.09.2015 to take necessary steps to select the petitioner to the post of Driver in the 2nd respondent Corporation.

ORDER

By consent, the writ petition is taken up for final disposal. The petitioner claims that he belongs to Most Backward Class Community and has completed 8th standard and is having all necessary and requisite qualification to get an appointment as driver in the services of the 2nd respondent / Corporation and though he has repeatedly participated in the selection process conducted by the 2nd respondent, so far no orders have been passed, appointing him to post of driver on daily rated basis and hence, the petitioner came forward to file this writ petition.

Learned counsel for the petitioner would submit that in the selection list bearing No.117/PRTC/Driv/Admin/2007-08 dated 23.03.2010 released by the 2nd respondent, the names of 138 drivers find place and the petitioner's name appeared in Sl.No.25 Code No.PDM

038. However, the petitioner has not been issued with any appointment order so far. In this regard, the petitioner has submitted a representation on 21.09.2015 and since no orders have been passed, the https://hcservices.ecourts.gov.in/hcservices/

petitioner is constrained to approach this Court and prays for appropriate orders.

This Court heard the submissions of Mr.Syed Mustafa, learned Special Government Pleader who accepts notice on behalf of the 1st respondent and Mr.A.R.Nixon, learned counsel who accepts notice on behalf of the 2nd respondent.

Though the petitioner has prayed for a larger relief, this Court, in the light of the above facts and circumstances and without going into the merits of the same, directs the 2nd respondent to consider and dispose of the petitioner's representation dated 21.09.2015 on merits and in accordance with law and pass orders within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. The writ petition is disposed of accordingly. No costs.
