The petitioner/Appellant has filed this petition to condone the delay of 297 days in filing the appeal against the award passed by the Motor Accidents Claims Tribunal, III Additional District Court, Kallakurichi, in MCOP No.44 of 2018, dated 04.02.2019.

2. Even though notice served on the respondents/claimants and their name is also printed in the cause list, none appeared on behalf of them.

3. Heard the learned counsel for the petitioner/appellant.

4. Considering the submission made by the counsel and being satisfied with the reasons assigned in the affidavit filed in support of this petition, the delay is condoned and this petition is allowed.

5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise the papers are found to be in order and post the matter on 09.11.2020 for admission.
