This petition is filed seeking leave to prefer an appeal against the judgement of the acquittal.
2. The petitioner had lodged a complaint alleging commission of offences under Sections 147, 294(b), 323, 354, 379, 506(2) of IPC against the respondents herein. The victim/ petitioner herein was examined as PW1 and her husband was examined as PW2. The learned judge had acquitted the respondents on the ground that there are contradictions in the depositions of the witnesses as regards the manner in which they were attacked by the respondents.
3. The learned counsel for the petitioner submitted that, the contradictions pointed out by the learned Judge are minor in nature; and that there is evidence to show that the petitioner sustained injuries; and that the petitioner had produced the AR copy and the wound certificates which were marked as Ex.P2 and Ex.P3 before the trial Court. 1/4
4. Though notice was served to the respondents, none appeared today.
5. This Court finds force in the submissions made by the learned counsel for the petitioner and hence inclined to grant leave. Accordingly, leave granted.
6.The Registry is directed to number the appeal and post for admission, if it is otherwise in order.
