Criminal Original Petition filed under Section 482 Cr.P.C. to direct the learned District Sessions Judge, Namakkal the Special Court for SC/ST Act cases to accept the surrender of the petitioner in Crime No.579 of 2015 on the file of Pallipalayam Police Station, Namakkal District and to consider the bail application on the same day.

O R D E R

The petitioner, alleging that he has been falsely implicated by the respondent for the alleged offences punishable under Sections 294(b) and 506(i) IPC and Section 3(1)(X) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act 1989, seeks a direction to the learned District Sessions Judge, Namakkal to consider the bail application to be filed by him on the same day of his surrender in Cr.No.579 of 2015 on the file of the respondent police.

2. Heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor.

3. Considering the nature of the prayer sought for and taking note of the fact that the petitioner is prepared to surrender before the learned District Sessions Judge, Namakkal, there shall be a direction to the learned District and Sessions Judge, Namakkal, the Special Court for SC/ST Act cases to consider the bail application to be submitted by the petitioner on his surrender before that Court, on the same day on merits and pass appropriate orders.
