Criminal Revision Petition is filed under Section 397 read with 401 of the Criminal Procedure Code, to set aside the Judgment dated 30.03.2012 passed in Crl.A.No.8 of 2012 on the file of the learned Principal District and Sessions Judge, Erode and restore the Judgment dated 03.01.2012 passed in S.C.No.141 of 2011 of the learned Principal Assistant Sessions Judge, Erode. This Criminal Revision Petition is filed by the petitioner / PW2, against the Judgment of acquittal dated 30.03.2012 passed in Crl.A.No.8 of 2012 on the file of the learned Principal District and Sessions Judge, Erode, in reversing the Judgment dated 03.01.2012 passed in S.C.No.141 of 2011 of the learned Principal Assistant Sessions Judge, Erode and prays to revise the same and set aside the same and restore the Judgment of the learned Assistant Sessions Judge, Erode.

Today, i.e. 18.09.2018, the learned Government Advocate (Crl.side) appearing for the respondent would submit that during the pendency of this Criminal Revision, the accused / 2nd respondent / Mathialagan died on 10.12.2013 and to that effect, the learned counsel for the respondent has produced the photo copy of the Death Certificate of accused / 2nd respondent / Mathialagan and hence the criminal revision as against the second respondent / accused stands abated.

Recording the above submission made by the learned counsel for the respondent, the Criminal Revision Petition is dismissed as abated.
