This Civil Miscellaneous Petition is filed to condone the delay of 54 days in filing the appeal against the judgment and decree dated 19.04.2017 made in M.C.O.P.No.164 of 2015 on the file of the Motor Accident Claims Tribunal, (III Additional District & Sessions Court), Kallakurichi, Villupuram District [earlier, M.C.O.P.No.100 of 2014, on the file of the Sub Court, Kallakurichi].

2.The learned counsel appearing for the petitioner-Insurance Company submitted that the 5th respondent, owner of the vehicle, remained exparte before the Tribunal and hence, notice may be dispensed with for the 5th respondent.

3.Though notice has been served on the respondents 1 to 4 and they entered appearance through counsel, today there is no representation for them.

4.Being satisfied with the reasons stated in the affidavit filed in support of the above petition, the delay of 54 days is condoned and the Civil Miscellaneous Petition is ordered.
