O R D E R

This Civil Revision Petition is filed against the order and decree passed by the learned Additional Sub Judge, Virudhachalam, in I.A.No.366 of 2009 in O.S.No.66 of 2005, dated 16.07.2009, to set aside the ex parte decree.

Mr.G.Parthasarathy, the learned counsel, representing Mr.S.Sathish Rajan, the learned counsel for the revision petitioner submitted that even before the filing of this Civil Revision Petition, the learned Additional Sub Judge, Viruduchalam, passed a final decree in the Suit itself, and has also made an endorsement to that effect on the reverse of the memorandum of grounds of this Revision Petition today. 3.

Since it is submitted by the learned counsel appearing for the revision petitioner that even before the filing of this Civil Revision Petition, the Trial Court passed a final decree in the Suit, which is not disputed by Mr.V.Anand, learned counsel appearing for the respondent, nothing survives in this Civil Revision Petition for any adjudication. Accordingly, this Civil Revision Petition is dismissed as having become infrucutuous. No costs. Consequently, connected Miscellaneous Petition is closed. 06.10.2016 sd Index : yes/no
