Crl.M.P.No. 7105 of 2023 in CRL. O.P. No.15810 of 2022 M.DHANDAPANI,J This petition is filed to modify the condition imposed to execute the 2 government sureties to the satisfaction instead of para no.3 is directed to the petitioner shall make a non refundable deposit of Rs.50,000/- for the purpose of improving and maintaining the Government Schools and another sum of Rs.50,000/- to the Cancer Institute (W1A) Regional Cancer Center Adayar. Chennai - 600 020 in CRL MP.NO.6772/2022 in CRL OP.NO.15810/2021 dated 09.05.2022. 2.This Court vide order dated 02.09.2021, granted anticipatory bail to the petitioner on condition that the petitioners shall deposit a sum of Rs.1,00,000/- (Rupees one lakh only) to the Cancer Institute, Adayar, Chennai and Rs.1,00,000/- for maintaining the Government Schools.

3. On the earlier occasion, the petitioner has filed a petition to modify the above said condition as against the petitioner that the petitioner shall make a non refundable deposit of Rs.50,000/- for the purpose of improving and maintaining the Government Schools and another sum of Rs.50,000/- to the Cancer Institute (WIA), Adayar, Chennai.

Today, when the matter is taken up for hearing, the learned counsel for the petitioners submitted that the petitioners are the daily wage worker and he is unable to mobilise the fund and deposit the amount as imposed on the petitioner by this Court. Hence, the learned counsel prays to modify the condition.

5. In view of the backdrop, the earlier condition imposed by this Court is on the basis of the petitioners instructions and his own volition. Now, this modification petition has filed on the different ground, which is not permissible. Hence, this petition for modification of the condition imposed by this Court dated in Crl.MP.No.6772 of 2022 in Crl.O.P.No.15913 of 2021, dated 19.05.2022 does not acceptance and accordingly, this miscellaneous petition is dismissed.
