Athmanathan v. Sarkunan

C.M.P.Nos.16412 of 2021 & 645 of 2019 C.M.P.Nos.16412 of 2021 & 645 of 2019 in S.A.No.912 of 2011 KRISHNAN RAMASAMY, J., C.M.P.No.16412 of 2021 has been filed to bring on record the petitioners herein as LRs of the deceased sole appellant and rank them as appellants 2 and 3 in the above Second Appeal.

2. C.M.P.No.645 of 2019 has been filed to set aside and recall the order made in S.A.No.912 of 2011 dated 24.04.2017 and rehear the appeal after giving an opportunity to the petitioner herein.

3. Heard the learned counsel appearing for the petitioners.

4. In C.M.P.No.649 of 2019, this Court vide order dated 08.08.2019, directed the petitioners to pay the costs of Rs.10,000/- to the respondent. Pursuant to the same, the petitioners complied the same and filed a proof to that effect.

5. Being satisfied with the reasons stated in the affidavit filed in support of these petitions and in view of the compliance of the order, dated 08.08.2019 by the petitioners, this C.M.P.No.16412 of 2021 & 645 of 2019 is allowed.

6. Registry is directed to carry out necessary amendment in S.A.No.912 of 2011 within the period of two weeks and post the matter on 09.01.2023. 15.11.2022 gbi (1/2) Note: Issue Order Copy on 16.11.2022.
