ORDER

This Criminal Original Petition has been filed for direction directing the third respondent to register FIR and investigate the private complaint forwarded by the learned Judicial Magistrate No.1, Thiruvannamalai under Section 175(3) BNSS as per order dated 24.12.2024 in Crl.M.P.No.3816 of 2024 filed by the petitioner.

2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner filed a petition seeking direction under Section 175(3) of BNSS before the Judicial Magistrate I, Tiruvannamalai in Crl.M.P.No.3816 of 2024. The Judicial Magistrate I, Tiruvannamalai, by an order dated 24.12.2024 directed the third respondent to conduct enquiry and proceed in accordance with law. However, so far, the third respondent did not conduct any enquiry and failed to register any FIR.

4. In view of the above, the third respondent is directed to register the FIR as against the accused as directed by the Judicial Magistrate No.1, Thiruvannamalai in Crl.M.P.No.3816 of 2024 dated 24.12.2024, forthwith and proceed with the investigation.
