PRAYER: Criminal Original Petition is filed under Section 439 of Criminal Procedure Code to enlarge the petitioner on bail in Crime No.681 of 2020 on the file of the Inspector of Police, Gomangalam Police Station, Coimbatore District.

ORDER

(The case has been heard through video conference) The petitioner, who was arrested and remanded to judicial custody on 12.09.2020 for the offences punishable under Sections 387 of IPC and later altered to under Section 392 and 397 of IPC, in Crime No.681 of 2020 on the file of the respondent police, seeks bail.

2.The case of the prosecution as per the defacto complainant is that on 12.09.2020, the petitioner waylaid him and threatened him with knife point and robbed a sum of Rs.500/- from him. 3.The learned counsel appearing for the petitioner would submit that the petitioner is innocent and he has been falsely implicated in this case. He would further submit that since the petitioner has previous cases against him, the respondent police demanded mamool from him and when the same was refused by him, they have impleaded him in this case by giving a false complaint. https://hcservices.ecourts.gov.in/hcservices/

4.The learned Government Advocate (Crl.Side) appearing for the respondent would vehemently oppose stating that the petitioner is a habitual offender and having eight (8) previous cases against him registered for the NDPS cases and he has been convicted in most of the cases.

5.Taking into consideration of the fact that the petitioner is a habitual offender and he has got eight previous NDPS Cases against him and he has also been convicted in most of the cases, this Court is not inclined to grant bail to the petitioner. 6.This Criminal Original Petition stands dismissed accordingly.
