The petitioner admittedly, filed a complaint before the District Consumer Disputes Redressal Forum in C.C.No.106 of 2020. Since the State Consumer Commissioner is functioning, the present Writ Petition filed seeking a direction to dispose of the complaint by the District Consumer Forum cannot be granted.
2. If any error is committed by the respondents 1 and 2, it is for the petitioner to raise all that grounds before the Consumer Forum in a pending complaint in C.C.No.106 of 2020. Against the order of the District Consumer Forum, appeal is contemplated under the Consumer Protection Act. This being the scheme of the Consumer Protection Act, the relief as such sought for in the present Writ Petition cannot be granted.
3. Accordingly, the Writ Petition stands dismissed. No costs. 09.02.2024 skr Index : Yes
