Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the Respondent 1 and 2 to rectify the errors which was done by the 1st respondent and direct Honourable District Consumer forum to taken up the case C.C.No. 106 of 2020 for hearing and may be directed to dispose off towards the compensation.

The petitioner admittedly, filed a complaint before the District Consumer Disputes Redressal Forum in C.C.No.106 of 2020. Since the State Consumer Commissioner is functioning, the present Writ Petition filed seeking a direction to dispose of the complaint by the District Consumer Forum cannot be granted.

2. If any error is committed by the respondents 1 and 2, it is for the petitioner to raise all that grounds before the Consumer Forum in a pending complaint in C.C.No.106 of 2020. Against the order of the District Consumer Forum, appeal is contemplated under the Consumer Protection Act. This being the scheme of the Consumer Protection Act, the relief as such sought for in the present Writ Petition cannot be granted.
