Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus, directing the respondents not to evict the petitioners from the Natham land in New S.F. No.305/1 at Marudurai Village, Kankeyam Taluk within the Sub Registration District of Chennimalai and Registration District of Erode to a total extent of 5500 sq.ft and consequently, direct the 4th respondent to consider the petitioners' representation dated 23.10.2024 in accordance with law within the time limit that may be fixed by this Honourable Court For Petitioners :

This writ petition has been filed for issue of a writ of mandamus forbearing the respondents not to evict the petitioners from 2/5

the subject property and to consider the representation made by the petitioners on 23.10.2024, wherein, the petitioners are seeking for issuance of patta with respect to the subject property.

2. Heard the learned counsel for the petitioners and the learned Additional Government Pleader for the respondents.

3. Taking into consideration the facts and circumstances of the case and considering the materials placed before this Court, there shall be a direction to the first respondent to deal with the representation made by the petitioners on 23.10.2024 on its own merits and in accordance with law.

4. The petitioners are claiming that the property in question is Grama Natham land. If it is so, the first respondent shall deal with the representation in line with the judgment of this Court in W.P.No.4936 of 2025 etc., batch dated 26.03.2025. In the alternative, if the subject property is categorized as Poromboke Land, the representation shall be dealt with in line with G.O.Ms.No.97 dated 21.02.2025. Final orders shall be passed within a period of twelve weeks from the date of receipt of a copy of this order.

The Writ Petition is disposed of in the above terms. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
