Respondents PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of Certiorarified Mandamus calling for the records of the 1st and 2nd respondents order in their proceedings No.Z.O.XV.C.No.3112/2012, dated 27.3.2013 quash the same and direct the respondents to remove the encroachment made by the 3rd respondent in the 20 feet road in Poonurangam 1st Cross Street, Injanbakkam, Chennai-115 within a stipulated time.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) On hearing learned counsel for respondents, it is directed that the Tahsildar/fourth respondent and Taluk Surveyor/fifth respondent will carry out the exercise of demarcation to locate whether any portion of the road has been encroached upon by the third respondent. In case such encroachment is found, action in accordance with law will be taken by the second respondent. The demarcation exercise be carried out within one month of the receipt of the order and action, if any required, be taken in accordance with law within two months thereafter.

2. The petition stands disposed of accordingly. No costs. Consequently, M.P.No.1 of 2013 is closed.
