ORDER

W.M.P.No.16818 of 2026 filed seeking permission to the petitioners to join together and file a single writ petition is ordered subject to payment of separate Court fee.

2. This writ petition has been filed seeking for a direction to the respondents to exclude the land more fully disclosed in the affidavit filed in support of this writ petition as per the provisions of Section 48-B of the Land Acquisition Act, 1894.

3. Even though the aforesaid prayer is sought for by the petitioner, learned counsel for the petitioner would submit, on instructions, that the petitioner is not seeking for reconveyance of the lands acquired from the petitioner but instead he is seeking only for enhanced compensation for the acquired lands.

Learned Special Government Pleader appearing for the respondents 1 and 3 would submit that by order dated 01.07.2024 passed by the Division Bench of this Court in W.A.No.1983 of 2021 etc. batch, the petitioner has been permitted to seek for enhanced compensation in respect of the entire lands, which is the subject matter of this writ petition.

5. According to the petitioner, the respondents have directed the petitioner to approach the Court to enable the respondents to consider the request of the petitioner for payment of enhanced compensation in respect of the entire lands, which is the subject matter of this writ petition.

As seen from the order of the Division Bench of this Court, referred to supra, the petitioner has been granted liberty to approach the respondents and seek for enhancement of compensation in respect of the lands acquired by the respondents under the Land Acquisition Act. The proceedings of the respondents have also been placed on record by the petitioner before this Court,

which reveals that the respondents have directed the petitioner to approach the Court and seek permission for the respondents to consider the request of the petitioner for payment of enhanced compensation in respect of the lands acquired from the petitioner, which is the subject matter of this writ petition.

7. No prejudice would be caused to any other parties if the petitioner is directed to submit a fresh representation to the respondents seeking for payment of enhanced compensation in respect of the lands, which are subject matter of this writ petition and a direction is issued to the competent authority to consider the same on merits and in accordance with law within a time frame to be fixed by this Court.

8. Accordingly, this Court directs the petitioner to submit a fresh representation to the third respondent seeking for payment of enhanced compensation in respect of the lands, which were acquired from the petitioner under the Land Acquisition Act, which is the subject matter of this writ petition, within a period of two (2) weeks from the date of receipt of a copy of this order. On receipt of the said representation within the stipulated time, the third respondent shall pass final orders on merits and in accordance with law on the petitioner's representation within a period of twelve (12) weeks thereafter.
