ORDER
This Petition has been filed seeking a direction respondents 1 to 5 to measure the porambokke land (Road) and the patta land in Survey No.549/2B and 544 situated at Ramagondahalli Village, Pennagaram Taluk, Dharmapuri District prior to the laying of Thar road and to take action as against the respondents 6 to 11 based on the representation of the petitioner dated 14.05.2024.
2. The learned counsel for the petitioner would submit that the petitioner is the absolute owner of the lands comprised in S.Nos.544/2D, 549/2A, 549/2B2, 549/2C, 449/2D and 550/1C2. While so, the authorities have decided to construct thar road in the place of earthen road and in pursuant to the same,without measuring the Government Poromboke land with the help of 5th respondent, the 6th respondent is trying to encroach upon the petitioner's lands for laying thar road. Therefore, the petitioner made a representation to the respondents 1 to 5 on 14.05.2024 to measure the Government Poromboke land and the petitioner's patta land prior to laying of thar road. However, the petitioner's representation was not considered by the respondents till date, thus the present writ petition has been filed before this Court.

The learned Additional Government Pleader appearing for the respondents 1 to 6 would submit that the 5th respondent would consider the petitioner's representation and carry out a survey and fix boundary stones at the subject properties within a time frame fixed by this Court, which was agreed to by the learned counsel for the petitioner.

In view thereof, the writ petition stands disposed of with the direction to the 5th respondent to consider the representation of the petitioner dated 14.05.2024, carry out a survey, demarcate the property and thereafter fix boundary stones at the subject properties, within a period of 12 weeks from the
date of receipt of a copy of this order after giving prior notice and reasonable opportunity of hearing to the petitioner, private respondents, adjacent land owners and other interested parties, including rival claimants, if any.
