Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondent to award the selection grade to the promoted post of Assistant on 27.10.1975 by promoting as Grade-I Assistant and also to revise the pay scale and pension in accordance with G.O.M.S.210 dated 11.03.1987 as per petitioners representation dated 04.09.2015.

By consent, the writ petition is taken up for final disposal. 2.The petitioner while working as Assistant in the services of the respondent had voluntarily retired from service on 31.06.1976 and he was drawing pension in terms of the proceedings dated 01.04.1976. The petitioner would submit that the pay scale of the petitioner was revised as 4000 - 100 - 6000 according to 6th pay commission as per G.O.Ms.No.200 dated 18.05.1999 and out of Rs.4000/-, Rs.2000/- was enhanced as pension form 01.04.1999 and the Government of Tamil Nadu has passed G.O.Ms.No.210 dated 11.03.1987 to award selection grade in promoted post in the promotional post and further clarified that the pay scale of promotional post and pay scale of post last held, was equal and if the person has worked for 10 years or more in the lower post and he works for 20 years or more in Grade - 1 or Grade - 2, the service rendered in the lower post may be counted for awarding selection grade in the promotional post.

3.The grievance expressed by the petitioner is that in terms of G.O.Ms.No.210 dated 11.03.1987, he is entitled to the said benefit and in this regard has also submitted a representation dated 04.09.2015 to the respondent and since no orders have been passed, came forward to file this writ petition.

4.Heard the submissions of Mr.M.Thamizhavel, learned counsel appearing for the petitioner and Mr.N.Srinivasan, learned Additional Government Pleader who accepts notice on behalf of the respondent. 5.Though the petitioner prayed for a larger relief, this Court in the light of the above facts and circumstances, directs the respondent to consider and dispose of the petitioner's representation dated 04.09.2015 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner. 6.The writ petition is disposed of accordingly.
