Writ Petition is filed under Article 226 of Constitution of India, praying for issuance of a Writ of Certiorarified mandamus, calling for the records of the 2nd respondent in connection with the impugned order passed by him in RC. No.38167/NGBV(2)/2016 dated 26.07.2016 and quash the same and direct the respondents to promote the petitioner notionally as Head Constable on completion of 5 years of service as Grade -I PC from the year 1981 and further promote her notionally as Sub Inspector of Police from the year 1996 and also grant further promotion as Inspector of Police notionally from the year 2007 with all service and monetary benefits and grant such other further relief.

ORDER

The captioned writ petition has been filed seeking the issuance of a writ of certiorarified mandamus, assailing the order dated 26.07.2016 passed by the 2nd respondent. By the said order, the petitioner's request for promotion to the post of Woman Inspector of Police was rejected.

2. Heard Mr. A.S. Mujibur Rahman, learned counsel for the petitioner, and Mr. J.K.Krishnamachari, learned Central Government Standing Counsel for the respondents. The materials placed on record have been perused.

3. The issue as to whether the Government Orders relating to time-bound promotions are applicable to women police personnel was examined by a Coordinate Bench of this Court in W.P. No. 35498 of 2019, etc., batch. The Coordinate Bench, by order dated 15.12.2021, in paragraph No. 64, held as follows:

"64. Therefore, the petitioners cannot claim to be similarly placed persons as that of their male counterparts who were recruited at the bottom at the entry point as Grade II Police Constables and thereafter upgraded as Grade I Police Constables at the end of 10 years as Grade II Police Constables, merely based on their designations."

4. In light of the above, this writ petition is dismissed as being devoid of merit. Consequently, the connected miscellaneous petition is closed. There shall be no order as to costs.
