Writ Petition filed under Article 226 of the Constitution of India seeking a Writ of Mandamus to direct the respondents 1 to 3 to remove the unlawful construction by the 4th respondent, encroacher over the land comprised in Survey No.137/1 to an extent of 50 cents in Madayathur Village, Chettipattu Ramiyan Kuppam Hamlet.

[Order of the Court was made by M. SUNDAR, J.] When the matter was taken up, Mr.A.V.Arun, learned counsel on record for writ petitioner, after expressing regret for missing the matter yesterday (to be noted, captioned matter is listed under the cause list caption 'FOR DISMISSAL' today) fairly submitted that the writ petitioner will approach jurisdictional Civil Court and sought leave of this Court to withdraw the captioned 'Writ Petition' {'WP'} and captioned 'Writ Miscellaneous Petition' {'WMP'}. Learned counsel made a plea to preserve all rights and contentions of writ petitioner to be canvassed in a civil suit which the writ petitioner intends to file. We accede to the fair request. The endorsement made by learned counsel for writ petitioner withdrawing the captioned WP and WMP thereat (endorsement in the case file) is as follows: Page Nos.2/4

2. In the light of the narrative thus far, captioned WP and captioned WMP are disposed of as withdrawn / closed albeit with preservation of rights in the aforesaid manner.
