Challenging the order passed by the 1st respondent rejecting the claim of the petitioner for rectification of errors in UDR Patta, the present Writ Petition has been filed.

2. It is case of the petitioner that the petitioner's father is in absolute possession and enjoyment of the property comprised in S.No.100/4 measuring an extent of 1.61. Acres in S.No.301/1 situated at Athur Village, Arakonam Taluk. However, during the course of Updating Registry Scheme (UDR), the extent of the above said lands have been wrongly entered in the revenue records. After repeated requests and reminder letters of the the petitioner to carry out the aforesaid corrections in the UDR patta and also for issuance of corrected patta in the name of the petitioner's father, the 1st respondent, upon conducting enquiry between the parties, had rejected the claim of the petitioner vide the present impugned order directing the petitioner work out the remedy before the competent civil court. Aggrieved by which, the petitioner has come up with the present Writ Petition.

Learned counsel appearing for the petitioner, on instructions, submitted that this Court may grant liberty to the petitioner to work out his remedy before the competent civil forum with regard to the aforesaid relief. However, the period before this Court shall be excluded for the purpose of limitation.
4. On the above contention, this Court heard the learned Government Advocate appearing for respondents 1 & 2.

5. Learned counsel appearing for impleaded respondents/respondents 5 to 13 submitted that during the pendency of this Writ Petition, the respondents 3 & 4 died. Since, the dispute between the parties is purely a civil dispute, it is prayed that liberty may be granted to the petitioner to work out the remedy as against the legal heirs of the respondents 3 & 4.

The issue involved in this Writ Petition is civil in nature which cannot be adjudicated by this Court under Article 226 and therefore the prayer sought for in this Writ Petition cannot be acceded to. In such view of the matter, this Court without interfering with the order impugned, grants liberty to the petitioner to work out his remedy with regard to the relief sought for in this Writ Petition as against the the legal heirs of the deceased respondents 3 & 4 before the competent civil forum. However, the period before this Court shall be excluded for the purpose of limitation.
7. This Writ Petition stands disposed of in the above terms. There shall be no order as to costs. Consequently, the connected Miscellaneous Petition is closed.
