ORDER : The Court Made the following order :- The petitioners who were arrested on 30.06.2021 for the offence under Section 294(b) and 307 of IPC in Crime No.694 of 2021, on the file of the respondent police, seek bail.

2. It is the case of the prosecution that the petitioner and the defacto complainant belong to same village. Due to previous enmity, a wordy quarrel arose between the petitioner and the defacto complainant's husband. For which, the petitioner along with other accused abused him with filthy language, assaulted him with knife and caused injuries. Based on the complaint lodged by the defacto complainant, the respondent police registered a case against the petitioner.

3. The learned counsel appearing for the petitioner submitted that the petitioner had nothing to do with the alleged offence as stated by the prosecution and they are in judicial custody from 30.06.2021. Hence, he learned counsel prays to grant bail to the petitioner.

4.The learned Government Advocate (Crl. side) submitted that the petitioner along with other accused attacked the defacto complainant's husband with iron rod and caused injuries. He further submits there is one previous case pending against the petitioner and this Court had already dismissed bail for the petitioner in Crl.O.P.No.12637 of 2021. Hence he vehemently opposed for grant of bail to the petitioner.

5.Considering the fact that there is one previous case pending against the petitioner and this Court had already dismissed bail to the petitioner and there is no change of circumstances, this court is not inclined to grant bail to the petitioner. 6.Accordingly, this criminal original petition is dismissed. -sd/- 04/08/2021 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
