ORDER
This writ petition has been filed seeking to direct the respondent 1 to 3, to pass appropriate orders on the representation dated 02.05.2023 made by the petitioner.
2.When the matter is taken up for hearing, none appeared on behalf of the petitioner.
3.Learned Government Advocate appearing for the respondents 1 to 3 would submit that the representation has been made by the petitioner seeking for restoration of the pathway. However, subsequent to the filing of this writ petition, a Civil Suit in O.S.No.31 of 2024 has been filed against the private
respondent before the Sub Court, Vaniyambadi, Thirupathur District, in respect of the same issue. Since the suit has been filed against the private respondents, the official respondents cannot consider the petitioner's representation at this stage.
4.As rightly contended by the learned Government Advocate appearing for the respondents 1 to 3, the right course available for the petitioner is to agitate the present issue before the Civil Court, where the suit is pending. The aforesaid submissions made by the learned Government Advocate is recorded. However, since there is no representation on behalf of the petitioner, this writ petition is dismissed for non-prosecution.
