Respondent Prayer:- Writ Petition has been filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus directing the respondent to appoint the petitioner in qualified post under Group II A Services as per the notification in Notification No.1 of 2014 dated 06.02.2014 by considering the petitioner representation dated 23.07.2015.

By consent, the writ petition is taken up for final disposal.

2. The petitioner has successfully completed M.Sc. and B.Ed. in Computer Science. The respondent issued Notification No.1 of 2014 dated 06.02.2014, calling for application for Combined Civil Services Examination - II (Non-Interview Posts) (Group II A Services). She has applied for the same and was allotted the Registration No.280111234. The petitioner has appeared in the written examination on 29.06.2014 and was successful. It is stated by the petitioner that certificate verification was done on 05.08.2015 and the date for counselling was fixed on 05.10.2015 (today). The petitioner was not called for counselling and on enquiry, she came to know that she had secured 210 marks and very many persons who belonged to the very same category as that of the petitioner had secured lesser marks than that of the petitioner, have been called for counselling and hence she came forward to file this writ petition. https://hcservices.ecourts.gov.in/hcservices/

3. When this writ petition came up for admission on 01.10.2015, on that date, the learned counsel appearing for the petitioner was permitted to serve notice on Ms.C.N.G.Niraimathi, learned standing counsel for the respondent.

The matter is listed today and the Court heard the submissions of the learned counsel appearing for the petitioner and the learned standing counsel appearing for the respondent on instructions would submit that out of the two candidates referred to by the petitioner, one candidate with Registration No.014305059 was not at all called for counselling and the another candidate with Registration No.020215196 has studied in Tamil medium and was called for counselling as that candidate comes under different category.

5. In the light of the said submission made by the learned standing counsel appearing for the respondent on instructions, this Court is of the view that the prayer sought for by the petitioner cannot be granted in the present facts and circumstances. Therefore, the writ petition is dismissed. Consequently, the connected miscellaneously petitions are closed. No costs. Sd/- Asst.Registrar (CS V ) /true copy/ Sub Asst.
