This application has been filed seeking to condone the delay of 17 days in filing an application to set aside the Arbitral Award dated 23.02.2022.
2. The reasons for the delay given by the applicant is that due to the Pandemic and due to the shifting of the applicant's office, the applicant could not file the application on time.
3. A notice has been duly served on the respondent in this application and the name of the respondent is also printed in the cause list. But despite the same, the respondent has not chosen to enter appearance in this application.
4. Since, the delay is only 17 days, which is permitted under Section 34 of the Arbitration and Conciliation Act and the reasons given by the applicant is satisfactory, this Court is inclined to allow this application.
5. For the foregoing reasons, this application to condone the delay of 17 days in filing an application to set aside the Arbitral Award is allowed as prayed for.
6. Registry is directed to number the O.P., if it is otherwise in order and list the same for admission.
