..Respondents PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Certiorarified Mandamus, calling for the records relating to the impugned rejection order dated 17.12.2025 passed by the 3rd Respondent in respect of the petitioner's application dated 27.11.2025 for issuance of Legal Heir Certificate, quash the same as illegal and void and consequently direct the 3rd Respondent to issue legal Heir Certificate in respect of the petitioner's son namely Kumaravel.

ORDER

The present writ petition has been filed praying for a certiorarified mandamus challenging the order of rejection of petitioner's request for issuance of a legal heir certificate vide order dated 17.12.2025.

2. Learned counsel for the petitioner would submit that the reasons for rejection is vague and in any event, invalid. The relevant portion of the impugned proceedings is set out hereunder"

"A court case regarding property is pending between the deceased Kumaraavel and his brother therefore the petition may be rejected."

3. On this being pointed out, learned Government Advocate for respondents would submit that they will re-consider the petitioner's application dated 27.11.2025 and pass appropriate orders, after issuing notice to petitioner and any other interested party, within a time frame to be fixed by this Court, which was agreed to by learned counsel for petitioner.

4. In view thereof, there shall be a direction to respondents, to consider petitioner's application dated 27.11.2025 on its own merits and pass appropriate orders, in accordance with law, after affording reasonable opportunity of hearing to petitioner as well as any other interested persons, within a period of eight (8) weeks from the date of receipt of a copy of this order.
