( Criminal Jurisdiction ) Monday, the Sixteenth day of August Two Thousand Twenty One PRESENT The Hon`ble Mr Justice M.DHANDAPANI CRIMINAL MISCELLANEOUS PETITION No.7832 of 2021 IN CRL OP.11833/2021 A.RATHINAM [ PETITIONER/ACCUSED ] Vs STATE REP BY [ RESPONDENT ] THE INSPECTOR OF POLICE, ETHAPPUR POLICE STATION, ETHAPPUR, SALEM DISTRICT CRIME NO. 333/2021 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to modify the condition that the petitioner shall report before Inspector of Police, D2 City Police Station, Pallapatti Police Station, Salem District daily at 10.30 a.m. for a period of two weeks instead of the petitioner shall report beore the responent police daily at 10.30 a.m. for a period of two weeks in the order dated 09.07.2021 in Crl.O.P. No. 11833 of 2021.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.T.VELU, Advocate for the Petitioner and of MR. C.E.PRATAP, Govt. Advocate ( Crl. Side) on behalf of the Respondent the court made the following order:- This petition has been filed to modify the condition imposed by this court vide order dated 09.07.2021 in Crl.OP.No.11833 of 2021, wherein the petitioner was directed to appear the respondent police daily at 10.30 a.m.

2.Learned Counsel appearing for the petitioner submits that the petitioner was transferred to some other work place and the respondent police station is 120 kilometers away from his work place, he seeks to modify the said condition as the petitioner may be directed to appear before D2 City Police Station, Pallapatti Police Station, Salem District which is near by to his work place. https://hcservices.ecourts.gov.in/hcservices/

3.The learned Government Advocate(Crl Side) submits that the Respondent police is the Investigation Officer and modifying the condition for appearance of the petitioner to some other police station will affect the investigation process. Hence he objects for modification of the said condition.

4. In view of the submissions made by the learned Government Advocate this petition is dismissed and the petitioner is directed to appear before the respondent police.
