ORDER : The Court Made the following order :- The petitioner, who was arrested on 22.06.2021 and remanded to judicial custody for the offences under Sections 174 Cr.P.C., @ 201, 294(b), 302 of IPC, in PRC.No.49 of 2021on the file of the Judicial Magistrate No.III, Vellore in Crime No.01 of 2015 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused persons and deceased were in a drunken mode, at that time, there was a wordy quarrel between them, the petitioner along with other accused persons had abused and attacked the deceased, due to which, he died on the spot and thrown into the pump set well. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is no way connected with the alleged offence and he has been falsely implicated in this case and the petitioner has been in jail from 22.06.2021. He further submits that based on the confession of one Logu, the petitioner was implicated in this case. He further submit that there are six previous out of which 5 cases are in acquittal and there is one previous case pending as against the petitioner. Therefore, he prays to grant bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent submitted that there are six previous cases pending as https://hcservices.ecourts.gov.in/hcservices/

against the petitioner and he is a history sheeter. Hence, he vehemently opposed for grant of bail to the petitioner.

5. Considering the facts and circumstances of the case and also the fact that there are six previous cases pending as against the petitioner, this Court is not inclined to grant bail to the petitioner.
