Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing the respondent herein namely the Inspector General cum Chief Security Commissioner/RPF, Southern Railway, Park Town, Chennai - 600 003, to consider and pass orders on the representation dated 15.03.2015, submitted by the Petitioner on merits and in accordance with law within a time-frame that may be stipulated by this court. ORDER

By consent, the writ petition is taken up for final disposal. The petitioner claims that he belongs to Other Backward Class community and he was appointed as Rakshak in the services of Railway Protection Force [RPF] in the year 1980 and so far put in 35 years of service and he was given promotion as Assistant Sub Inspector of Police under 60% quota in the year 2006 and whereas his batch mates were promoted to the said post even in the year 2004. The petitioner was called for the selection to the post of Sub Inspector of Police in the year 2012 and he attended the selection and viva-voce and performed well and the seniority was fixed at Sl.No.56 out of 70.

The petitioner would submit that after filling up SC/ST quota, there are six more vacancies left unfilled and in spite of it, the name of the petitioner has not been empanelled and in this regard, he has repeatedly submitted the representations dated 06.10.2013, 05.03.2014, 24.03.2014, 18.04.2014, 20.10.2014 and 15.03.2015 to the Chief Security Commissioner, Railway Protection Force, through proper channel and https://hcservices.ecourts.gov.

since he has not been favoured with any response, the petitioner came forward to file this writ petition.

Heard the submissions of the learned counsel for the petitioner and Mr.P.T.Ramkumar, who accepts notice on behalf of the respondent.

This court, taking into consideration, limited scope of prayer sought for by the petitioner and without going into the merits of the same, permits the petitioner to submit one more representation to the respondent within a period of two weeks from the date of receipt of a copy of this order by enclosing a copy of this order as well as the copies of the earlier representations and the respondent, on receipt of the same, is directed to consider the same on merits and in accordance with law after putting on notice the persons concerned and pass orders within a further period of eight weeks thereafter and communicate the decision taken, to the petitioner as well as to the persons concerned.
