(CRIME NO. 59 OF 2021) Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) relax the condition 7(b) imposed on the petitioner in Crl.O.P.No.8901 of 2021 dated 12.05.2021 that he should appear before the Respondent Police daily at 10.30 am and 5.00 p.m. until further orders (ii) relax the condition 7(b) that the petitioners shall report before the respondent police daily at 10.30 am and 5.00p.m. Until further orders imposed in CRL.O.P.No.8901 of 2021 dated 12.05.2021 on the file of this Hon`ble High Court.
Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S.R.GIRIJA, Advocate for the petitioner in CRL.MP.NO.7956/2021, in CRL OP.8901/2021, M/S C.DEEPAK KUMAR, Advocate for the petitioner in CRL.MP.NO.7956/2021 in CRL OP.8901/2021 and of M/S. C.E.PRATAP, Govt. Advocate ( Crl. Side) (IN BOTH THE PETITIONS) on behalf of the Respondents the court made the following order:-
Vide order dated 12.05.2021, this Court had enlarged the petitioner on bail on certain conditions. This petition has been filed by the petitioner seeking relaxation of the conditions.
2. Learned Addl. Public Prosecutor appearing for the respondent, on instruction, submits that the petitioners have been complying with the conditions without fail.
3. In view of the above submission, this Court is of the considered view that the prayer as sought for by the petitioners could be acceded to.
4. Accordingly, the condition insofar as appearance as imposed by order dated 12.05.2021 alone stands modified and the petitioners shall appear before the respondent Police, on every Monday at 10.30 a.m. till the investigation is completed and charge sheet is filed and thereafter, shall appear before the concerned trial Court on each and every date of hearing.
