Writ Petition filed under Article 226 of the Constitution of India seeking issuance of a Writ of Mandamus directing the 3rd respondent to consider the petitioner's representation dated 04.02.2025 and to survey the land measuring 38 Cents in S.No.511/10 of Barur Revenue Village, Poochampalli Taluk, Krishnagiri District by metes and bounds for rectifying the F.M.B and to issue separate patta in favour of the petitioner in pursuance of the proceedings of the 2nd respondent in proceedings in O.Mu.5257/2025/LR-R2 dated 26.03.2025 within a time stipulated by this Court.

O R D E R

This writ petition has been filed seeking issuance of a writ of mandamus directing the third respondent to deal with the representation made by the petitioner on 04.02.2025 wherein the petitioner is seeking for survey of the subject property and for demarcation of boundaries and rectify the mistake crept in the FMB sketch and consequently, issue separate patta in favour of the petitioner pursuant to the proceedings of the second respondent dated 26.03.2025.

2. Heard Mr.A.Ilaya Perumal, learned counsel for petitioner and Mr.S.Jayachandran, learned Government Advocate appearing for respondents.

3. The petitioner is seeking for correction in the FMB sketch and for issuance of separate patta in his name by showing the correct measurement. Since the same was not considered, the present writ petition has been filed before this Court.

4. It is seen from records that the representation made by the petitioner was acted upon by the first respondent and it was forwarded to the third respondent for enquiry and for filing a report. Thereafter, there was no progress. It is under these circumstances, the present writ petition came to be filed before this Court.

Considering the facts and circumstances of the case and the materials placed before this Court and considering the fact that ultimately the third respondent will be able to carry out the correction in the FMB only after getting approval from the Director of Survey and Settlement and thereafter, issue patta in favour of the petitioner, this Court is 3/4

N.ANAND VENKATESH, J gm inclined to fix a time limit. Hence, the third respondent shall act upon the request made by the petitioner and take a decision within a period of twelve (12) weeks from the date of receipt of a copy of this order. This writ petition is disposed of with the above direction. No costs.
