ORDER
The petitioner, who was arrested and remanded to judicial custody on 27.06.2025 for the offences punishable under Sections 126(2), 296(b), 103(1), 61(2) and 49 of BNS Act, in Crime No.179 of 2025 on the file of respondent police seeks bail.
2.The allegation against the petitioner is that A1 and A7 were having an illicit relationship and when the same was questioned by the deceased, A1 to A7 engaged A2 to A5 who are hirelings by paying a sum of Rs.10,00,000/- to murder the deceased. In pursuance of the said conspiracy, while the deceased was travelling alone, he was intercepted and attacked by A3 to A5 indiscriminately with knife, resulting in which, he died. Hence, the respondent police registered a case against the petitioner and he was arrested and remanded to judicial custody on 27.06.2025.
3. The learned Counsel for the petitioner submitted that the petitioner is an innocent person and he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner was arrested and remanded to judicial custody on 27.06.2025. He further submitted that the co-accused were granted bail by this Court in Crl.O.P.No.27039 of 2025 dated 07.10.2025, and Crl.O.P.No.6954 of 2026 dated 17.03.2026. He further submitted that the petitioner is ready to co-
operate with the investigation. Hence, he prayed for grant of bail to the petitioner.

Mr.V.J.Priyadarsana, learned Government Advocate (Criminal Side) appearing for the respondent police, reiterated the prosecution case and submitted that it is a case of murder by engaging hirelings and the petitioner is also one of the hirelings and he has also attacked the deceased and the petitioner is having one previous case. Therefore, he vehemently opposed to grant bail to the petitioner.
5.Considering the gravity of offence committed by the petitioner; that the petitioner is also a part of gang engaged for murdering the deceased, and specific overt-act against the petitioner; that the petitioner is having one previous case; though the co-accused in this case were released on bail, specific overt-act attributed against the petitioner/A3, this Court is not inclined to grant bail to the petitioner.
