ORDER
This petition has been filed by the petitioners praying to grant a Succession Certificate under Section 372 of the Indian Succession Act, 1925, Order XXV Rule 6 of the Original Side Rules, in favour of the first petitioner with powers to collect the securities and to receive the interest and dividends thereon and negotiate and transfer the securities specified in the Schedule.

2. According to the petitioners, the deceased Mr.Vidyasagar Kidambi, S/o. Late Venkata Raghavachari, died leaving behind his legal heirs, the petitioners herein. Subsequently, Mrs.Mangala Kidambi, W/o.Mr.Vidyasagar Kidambi, died on 29.04.2024. The petitioners are the surviving legal heirs of late Mr.Vidyasagar Kidambi, entitled to the estate of the deceased Mr.Vidyasagar Kidambi. The first petitioner is the eldest son and the second and third petitioners are the daughters of the deceased Mr.Vidyasagar Kidambi.
(b) During the lifetime of the deceased Mr.Vidyasagar Kidambi, he had securities and mutual funds in the ICICI Prudential, and in order to transmit the said shares in the name of the petitioners, a Succession Certificate is necessary and the second and third petitioners/daughters of the deceased Mr.Vidyasagar Kidambi, have agreed to issue a Succession Certificate in favour of the first petitioner/son of the deceased Mr.Vidyasagar Kidambi. Therefore, the petitioners filed this Original Petition.
3. After the filing of this Original Petition, the petitioners were Page No.2 of 7
directed to effect paper publication, and the same was also effected. No objection was received from any party. Thereafter, the matter was posted for examination of witnesses, and the evidence was recorded.
4. In order to prove the case of the petitioners, they examined P.W.1 and marked Exs.P1 to P8.
5. This Court also perused the entire documents including the evidence.
6. On a careful perusal of the evidence of P.W.1 and Exs.P1 to P8, they revealed that the deceased Mr.Vidyasagar Kidambi is the father of the petitioners, and he died on 04.06.2020, left behind the petitioners as his legal heirs. During his lifetime, he purchased mutual funds in the ICICI Prudential, and now, in order to get the said mutual funds, the petitioners are required to have a Succession Certificate. Each of the petitioners is equally entitled to the share of the mutual funds of the deceased Mr.Vidyasagar Kidambi. Further, the second and third petitioners have Page No.3 of 7
consented to issue a Succession Certificate in favour of the first petitioner. Hence, the first petitioner is entitled to Succession Certificate as prayed for in this Original Petition.

In view of the same, this Original Petition is allowed, and a direction for the grant of a Succession Certificate in favour of the first petitioner, Mr.Rangarajan Kidambi, S/o.Vidyasagar Kidambi, with the powers to collect the securities and to receive the interest and dividends thereon and negotiate and transfer the securities specified in the Schedule, as applicable, till the date of withdrawal, is issued. 06.11.2025 Index :
